By participating in the vote, you are deemed to have accepted and agreed with all of the terms and conditions set out below and undertake to comply with all applicable laws and regulations in the course of participating in this vote. Participation in the vote (hence the lucky draw (the “Lucky Draw”)) can only be by filling in the online form on the designated website of The Hong Kong Jockey Club and submitting that form, and the participant shall bear his/her own costs for or in connection with the participation in the vote and/or Lucky Draw and/or any related matters.
All participants must be at least 18 years of age and hold valid Hong Kong Identity Card or Hong Kong travel document. The registered name of the participant must be the same as shown on his/her Hong Kong Identity Card or Hong Kong travel document. All prize winners will be required to present their Hong Kong Identity Card or Hong Kong travel document for verification upon prize collection.
Staff members of The Hong Kong Jockey Club and their respective immediate families (meaning spouse, parents and parents-in-law, children and children-in-law, siblings and siblings-in-law, grandparents and grandparents-in-law, and grandchildren and grandchildren-in-law, etc.) will be disqualified from participating in the Lucky Draw. The Hong Kong Jockey Club reserves the right to verify the eligibility of all participants. Nevertheless, the votes cast by staff members of The Hong Kong Jockey Club and/or their respective immediate families will still be counted for the purpose of determining the Most Popular Hose of the Year, the Most Popular Jockey of the Year and the Most Admired Overseas Horse of the Year.
Each participant will be entitled to one lucky draw prize only. If multiple votes have been found to be casted under the same registered name in English and mobile phone number, only the first vote will be considered valid.
There are three voting categories, namely, the Most Popular Horse of the Year, the Most Popular Jockey of the Year, and the Most Admired Overseas Horse of the Year. The jockey / horse with the highest number of votes in each category will be named the Most Popular Horse of the Year, the Most Popular Jockey of the Year, and Most Admired Overseas Horse of the Year (as the case may be). For the avoidance of doubt, to participate in the Lucky Draw, (a) each voter must vote in all three categories to be eligible, and (b) each voter is not required to have voted the title winning jockey / horse.
Voting forms submitted after voting period has ended will not be accepted. If a participant has chosen more than one horse, more than one overseas horse, and/or more than one jockey in one of the voting categories, and/or failed to submit a vote for all three voting categories, the vote submission will be voided, will not be used for vote counting, and will not be eligible to participate in the lucky draw.
Proof of dispatch cannot be accepted as proof of submission of any entry. The Hong Kong Jockey Club does not accept responsibility for any loss, damage, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control, or any other loss howsoever caused.
Upon determination of the result of the Lucky Draw on July 16, 2018, The Hong Kong Jockey Club will contact the drawn participants by up to 10 telephone calls within 3 calendar days to the telephone number of the drawn participant registered at the vote and to inform the prize collection. If any drawn participant is out of reach, he/she will be disqualified and his/her prize will be passed to the first drawn original winner of the next and lower prize, and so forth.
Example for illustration only: if the Grand Prize is forfeited, the original winner of the Second Prize will become the new winner of the Grand Prize, and the first drawn original winner of the Third Prize will become a new winner of the Second Prize and the drawn participant ranked the top of the waiting list will become the new winner of the Third Prize immediately.
The prize winners and the result (including prize winner’s full name and first 4 digits of mobile phone number) of the Lucky Draw will be announced on July 23, 2018 in The Hong Kong Jockey Club’s website www.hkjc.com, Sing Tao Daily and The Standard. The announcement will be made for fulfilment of duty owed by licensee of Trade Promotion Competition Licence only, and shall in no event indicate or suggest any second round of the Lucky Draw or any re-draw.
The prize winners must appear in person at such designated location, date and time as The Hong Kong Jockey Club may determine for prize collection. All prize winners are required to present their original Hong Kong Identity Card or travel document for verification purposes. Prizes must be redeemed within 60 days of the announcement of the prize winners and result (being, from 23 July 2018 to 22 September 2018, both dates inclusive). Redemption by delegates is not allowed.
The name list of all participants and personal information will be destroyed one month after the end of this event.
Prizes cannot be exchanged for cash.
The Hong Kong Jockey Club is not the manufacturer of some of the prizes. The Hong Kong Jockey Club does not accept any liability for the quality of such prizes, therefore to the maximum extent permitted by law of the Hong Kong Special Administration Region, The Hong Kong Jockey Club does not accept any responsibility or liability whatsoever for any damage, loss, death or personal injury arising from or in connection with the use or enjoyment of any of such prizes. The use and enjoyment of such prizes by the winner is subject to the terms and conditions of the supplier and any dispute arising from the use and enjoyment of any of the prizes shall be resolved between the winner and the supplier directly, for which The Hong Kong Jockey Club accepts no responsibility or liability whatsoever. Further, the actual appearance or colour of the prizes may differ from what is shown in the photos.
The Hong Kong Jockey Club reserves the right to use any recorded footages and/or photos of winners for promotional and/or record purpose of this game (including without limitation, organisation of any other activity in connection with this game and/or the subject matter thereof).
Entrants must take care of and be responsible for their own personal belongings and safety. To the maximum extent permitted by laws of the Hong Kong Special Administrative Region, The Hong Kong Jockey Club shall neither be responsible nor pay any compensation for the loss or damage to any property nor injury or death sustained by entrants.
The vote, the Lucky Draw and these Terms and Conditions shall be governed in all respects by the laws of the Hong Kong Special Administrative Region. Each participant is fully responsible for ensuring that his or her participating in the vote and/or lucky draw is lawful in accordance with the laws of the Hong Kong Special Administrative Region. The Hong Kong Jockey Club shall not be taken to make any representations, express or implied, as to the lawlessness of any participation. In the event of any dispute, the decision of The Hong Kong Jockey Club shall be final.
Both the participants and The Hong Kong Jockey Club agree and acknowledge that (1) they do not intend any term of these Terms and Conditions to be enforceable by any third party pursuant to the Contracts (Rights of Third Parties) Ordinance (Cap 623); and (2) these Terms and Conditions shall be excluded from the application of the Contracts (Rights of Third Parties) Ordinance.
These Terms and Conditions are drafted in English and translated into Chinese and are available on The Hong Kong Jockey Club’s website www.hkjc.com. In submitting their votes, each participant acknowledges and agrees that he/she has read and understood these Terms and Conditions and that he/she is fully aware of the rights and obligations arising therefrom. In the event of any discrepancy between the two versions, the English version shall prevail.
