- By participating in this ‘Say Thank You online engagement feature’ (the “Activity”) on The Hong Kong Jockey Club’s 140th Anniversary campaign site (the “Anniversary Site”) of The Hong Kong Jockey Club (“the Club”), participants are deemed to have agreed with and accepted these terms and conditions and undertake to comply with all applicable laws and regulations in the course of participating in the Activity.
- To participate in the Activity, participants must take a photo or upload a photo that will be transformed into an online avatar through an artificial intelligence service provided by an third party appointed by the Club. Participants shall use said avatar in a personalised ‘Thank You’ card, on which the participants will be asked to fill in the recipient’s name, a personalised message to the said recipient, the participant’s own name and email address.
- Participants must not submit, send or transmit any information or material (including but not limited to content and photo) that is illicit, insulting, defamatory, discriminatory, offensive, vulgar, obscene, pornographic, or contains indecent elements, foul language, any other unlawful elements or elements that would incite a crime, personal attacks, commercial advertising or content that may infringe intellectual property or privacy of others (collectively, "Unacceptable Contents"), and must not use any materials created or produced during the Activity in any Unacceptable Contents. The Club reserves the right to remove any information or material which we consider to be Unacceptable Contents as aforesaid and disqualify the relevant participants without prejudice to the remedies or relief available to the Club under the law.
- The Club does not accept any liability and/or shall not be responsible for any loss or damage the participants may suffer in connection with or arising from their participation of or use of any materials created in the Activity. The intellectual property rights of all materials of the participants submitted or produced during the Activity shall be vested in the Club, but participants have a non-exclusive licence to use the relevant materials produced for private non-commercial purposes.
- Use of digital devices and/or mobile devices may be required during the Activity. Neither the Club nor its service provider accepts any liability or responsibility for any data loss, damage, error, omission, interruption, deletion or defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside of its control, or any other loss howsoever caused.
- The Club reserves the perpetual, irrevocable, non-exclusive, worldwide, sub-licensable and royalty-free right to use and/or publish all or any part of the materials submitted or created during the Activity for promotional, marketing and other purposes (including without limitation, organisation of any other activities in connection with this Activity and/or the subject matter thereof) subject to any alteration that the Club may make with or without attribution to the relevant participants.
- The Anniversary Site may request for access to your mobile device’s camera. Neither the Club nor its service provider accepts any liability and/or shall be responsible for any loss or damage you may suffer in connection with or arising from your use of the Anniversary Site.
- Participants shall not participate in this Activity using any means which may cause disruption to the operations of the Club’s digital channels. The Club reserves the right to pursue legal action.
- The Club reserves the sole and exclusive right to make decisions relating to the Activity, and may cancel, postpone or modify any content of the Activity (including but not limited venue, date or time, performance or other activities, entry requirements, gift, discount or other offerings) or amend the relevant terms and conditions, at any time without notice, and without liability for refund, compensation or otherwise. In case of any dispute, the decision of the Club shall be final.
- The Club reserves the right to amend any of these Terms and Conditions at any time without prior notice. In case of any dispute in relation to the Terms and Conditions, the decision of the Club shall be final.

All participants expressly confirm that they have read and understood the Club's Privacy Policy Statement at
http://www.hkjc.com/english/corporate/corp_privacy.asp, and further agree that the Club may use their personal data in the course of and/or for the purpose of this Activity. The Club’s appointed contractor, vendor or third-party service provider etc. (collectively, “contractor”) may assist the Club to collect, use, store, keep or other means to process the data. The Club will ensure that personal data collected and used are in compliance with the Club’s Privacy Policy Statement. - This Activity and these Terms and Conditions shall be governed in all respects by the laws of the Hong Kong Special Administrative Region. Each participant is fully responsible for ensuring that his or her participation in this Activity is lawful in accordance with laws of the Hong Kong Special Administrative Region and any other applicable laws. The Club shall not be taken to make any representations, express or implied, as to the lawfulness of any participation.
- In case of any dispute, the decision of the Club shall be final.
- These Terms and Conditions are available in both Chinese and English. In the event of any inconsistency between the two versions, the English version shall prevail.
